These Terms of Service ("Terms") are an agreement between you and SPARKON JOINT STOCK COMPANY ("Sparkon", "we", "us"), enterprise code 0111633590, 2nd Floor, HHN01 Building, No. 47 Nguyen Tuan Street, Thanh Xuan Ward, Hanoi, Vietnam. They apply to every mobile game we publish (the "Games"). By downloading or playing a Game, you agree to these Terms and to our Privacy Policy.
1. Eligibility
You must be at least 13 years old (or the minimum age in your country) to play. If you are under the age of majority where you live, your parent or guardian must agree to these Terms for you.
2. License
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Games on devices you own or control, for your own non-commercial entertainment. We and our licensors keep all rights in the Games, including their code, art, music, characters and trademarks.
Where you obtained a Game from the Apple App Store, these Terms also include Apple's Licensed Application End User License Agreement. Apple is not responsible for the Games or their support.
3. Your account and progress
You can play anonymously or sign in with Game Center or Google. You are responsible for activity under your account. Anonymous progress is tied to your device and may be lost if you delete the Game or change devices without signing in.
4. Rules of play
You agree not to:
- cheat, use bots, hacks, mods or exploits, or manipulate in-game currency or items;
- reverse engineer, decompile or modify the Games, except where the law allows it;
- interfere with our servers or other players' experience;
- sell, trade or transfer accounts, virtual items or currency outside the Game;
- use the Games for any unlawful purpose.
We may suspend or terminate access, or reset progress, items or currency, if you break these rules.
5. Virtual items and in-app purchases
- The Games may offer virtual currency and items ("Virtual Items") for real money through Apple or Google. Virtual Items are a limited license to use content in the Game. They have no cash value, cannot be exchanged for real money, and are not your property.
- All purchases are processed by Apple or Google under their terms. Except where the law requires otherwise, purchases are final. Refund requests are handled by Apple (reportaproblem.apple.com) or Google Play under their refund policies.
- We may change, rebalance or remove Virtual Items, for example when we update the Game. We are not liable for loss of Virtual Items when a Game ends, except as required by law.
- If a purchased item does not arrive, use "Restore Purchases" in the Game or contact support@sparkongames.com.
6. Advertising
The Games show ads from third parties. We are not responsible for third-party ads or for products and websites they link to. See our Privacy Policy for how ads use data and how to opt out of personalized ads.
7. Updates and availability
We may update, change or stop offering any Game or feature at any time. Some updates may be required to keep playing. Games may need an internet connection, and we do not promise they will be always available or error-free.
8. Third-party services
The Games use services from Apple, Google, Unity and other providers. Your use of those services is also subject to their terms.
9. Disclaimer
The Games are provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the extent permitted by law, Sparkon is not liable for indirect, incidental, special or consequential damages, or for loss of data, progress or Virtual Items. Our total liability to you for any claim is limited to the amount you paid us in the 6 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your mandatory rights as a consumer in your country.
11. Governing law and disputes
These Terms are governed by the laws of Vietnam. Before starting a formal claim, please contact support@sparkongames.com so we can try to resolve the issue. Disputes will be settled by the competent courts of Hanoi, Vietnam, unless the consumer law of your country gives you the right to bring a claim in your local courts.
12. Changes to these Terms
We may update these Terms. We will change the effective date above and, for material changes, notify you inside the Game. If you keep playing after the change, you accept the new Terms.
